Terms of Use
Effective at launch
These terms are an agreement between you and Bacon Like The Food Productions LLC ("we" or "us"), the maker of Arkeep. By buying, installing or using Arkeep, you agree to them. If you're using Arkeep for a business, you're agreeing for that business.
What Arkeep is, and what it isn't
Arkeep checks your cards and drives against an index of your archive drives, tells you which files already have a copy there, copies what's missing to drives you choose, and verifies those copies.
Arkeep is not a backup service. It doesn't keep its own copy of your files, and it can't bring back files from a drive that fails, is lost or is erased. It can only tell you what was on that drive. When Arkeep says a card is "safe to format," that means every file on it was found and verified on your archive drives at the time of the check. Deciding to format a card or erase a drive is always your choice.
Arkeep never deletes, moves or changes the files on your cards and drives, except to write the copies, folders and offload proofs you ask it to make.
Your license
When you buy Arkeep, you get a personal, non-exclusive, non-transferable license to use it on your own computers, as described below. You're buying a license to use the software, not the software itself.
- Personal license: for one person, on up to 2 computers they own or use.
- Studio license: for a team. The owner can add seats, and each seat is for one person on up to 2 computers.
- The iPhone app is included with a Mac license. It works while the Mac license it's paired with is active.
- Free licenses we give for press, creators, beta testers or other reasons follow these same terms, and may end on a date we tell you.
You can see and remove the computers on your license from the "Your licenses" page on arkeep.app.
Updates
Your purchase includes one year of updates, starting on the day you buy. After that, you can renew the updates plan to keep getting new versions: $29 a year for a Personal license, or $79 a year for a Studio license plus $10 a year for each extra seat.
If you don't renew, Arkeep keeps working. You keep the last version released while your plan was active, for as long as you like. Updates released after your plan ends won't install until you renew. Canceling the updates plan never turns off the app.
Founders pricing, when offered, is a lower price for early buyers. It applies to the purchase and renewals described at the time you buy.
When a license stops working
A license is turned off if you get a refund, if a payment is reversed through a chargeback, if a free license reaches its end date, or if you break these terms. When that happens, the Mac app shows a screen where you can enter another license key, buy a license, or export your Arkeep history. You can always export your history, so the record of your archive is never locked away from you. The iPhone app stops working until it's paired with a Mac that has an active license.
What you agree not to do
- Share, sell or publish your license key, or use one key for more people or computers than it covers.
- Get around the license check, or change, copy or reverse-engineer Arkeep, except where the law allows it regardless of these terms.
- Resell, rent or redistribute Arkeep.
- Use Arkeep to break the law or to access drives or files you don't have the right to access.
Your files and your data
Your files, drives and index are yours. We don't claim any rights to them. How we handle the small amount of information we do receive is explained in our Privacy Policy.
You're responsible for your own drives and storage, including keeping more than one copy of anything you can't afford to lose.
Disclaimer
We work hard to make Arkeep accurate and reliable, but it's provided "as is." To the fullest extent the law allows, we don't promise that Arkeep will be free of errors or will work without interruption, and we disclaim all other warranties, including warranties of merchantability, fitness for a particular purpose and non-infringement.
Arkeep's results depend on your drives, cards, computers and the files on them. Hardware can fail, and files can change after a check.
Limit of liability
To the fullest extent the law allows, we aren't liable for lost files, lost data, lost profits, or any indirect, incidental or consequential damages from using or not being able to use Arkeep, even if we were told they might happen. Our total liability for any claim about Arkeep is limited to the amount you paid for Arkeep in the 12 months before the claim.
Some places don't allow these limits, so they may not all apply to you.
Ending this agreement
You can stop using Arkeep at any time. We can end your license if you break these terms. The sections about the disclaimer, limit of liability and governing law continue after the agreement ends.
Governing law
These terms are governed by the laws of the State of Georgia, USA. Any dispute will be handled in the state or federal courts in Fulton County, Georgia, unless the law where you live gives you the right to bring it somewhere else.
Changes to these terms
If we change these terms, we'll update the date at the top and post the new version on arkeep.app. If a change is significant, we'll email you before it takes effect. Using Arkeep after a change means you accept the new terms.
